Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of VoidedCheck.org (the "Service"), operated by VoidedCheck.org ("we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on this page. Your continued use of the Service following the posting of revised Terms means you accept and agree to the changes.

Description of Service

VoidedCheck.org provides an online voided check generation service. Our Service allows users to create professionally formatted voided checks by entering their banking information, personal details, and payment information. The generated voided check is delivered via email and can be used for direct deposit setup, automatic bill payments, ACH authorization, and other legitimate banking purposes.

Eligibility

You must meet the following requirements to use our Service:

  • You must be at least 18 years of age
  • You must have the legal capacity to enter into a binding contract
  • You must have a valid bank account with a US-based financial institution
  • You must provide accurate and complete information
  • You must not be prohibited from using the Service under applicable law

By using the Service, you represent and warrant that you meet all of these eligibility requirements.

Account and Registration

While account creation is not required to use our Service, you are responsible for:

  • Providing accurate, current, and complete information during the checkout process
  • Maintaining the security of your email account used to receive your voided check
  • All activities that occur through your email or payment information
  • Notifying us immediately of any unauthorized use or security breach

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, particularly if we suspect fraudulent activity or violation of these Terms.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Provide false, inaccurate, or misleading information
  • Use another person's banking information without authorization
  • Create voided checks for fraudulent purposes
  • Attempt to defraud, deceive, or mislead us or other users
  • Use the Service to violate any local, state, federal, or international law
  • Attempt to gain unauthorized access to our systems or networks
  • Use automated systems (bots, scrapers) to access the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload viruses, malware, or any malicious code
  • Harvest or collect information about other users
  • Use the Service in any way that could damage our reputation or business

Violation of these acceptable use provisions may result in immediate termination of your access to the Service and potential legal action.

Payment and Fees

Pricing

The price for generating a voided check is clearly displayed on our website before purchase. All prices are in US Dollars (USD) and include all applicable taxes unless otherwise stated.

Payment Processing

All payments are processed securely through our third-party payment processor, Stripe. By providing payment information, you:

  • Authorize us to charge the specified amount to your payment method
  • Represent that you are authorized to use the payment method provided
  • Agree to pay all charges incurred by you or anyone using your payment method
  • Acknowledge that payment processing is subject to Stripe's terms and conditions

No Refunds

All sales are final. Due to the digital nature of our Service and immediate delivery of the voided check upon generation, we do not offer refunds except in the following circumstances:

  • Technical error on our part that prevents generation or delivery of your voided check
  • Duplicate charges for the same transaction
  • Service unavailability that prevents you from receiving your voided check

Refund requests must be submitted within 7 days of purchase to info@onbiz.com. We will review each request on a case-by-case basis and respond within 5-7 business days.

Declined Payments

If your payment is declined, we will not generate or deliver your voided check. You may attempt payment again or contact your financial institution to resolve the issue.

Service Delivery

Delivery Method

Your generated voided check will be delivered to the email address you provide during checkout. Delivery typically occurs within 60 seconds of successful payment, though delays may occasionally occur due to technical issues or email service provider delays.

Accuracy of Information

You are solely responsible for ensuring that all information entered (banking details, name, address) is accurate and complete. We are not responsible for errors resulting from incorrect information provided by you.

If you discover an error after generation, you may purchase a new voided check with corrected information. We do not offer free regeneration for user input errors.

Acceptance by Third Parties

While our voided checks are formatted to meet standard banking requirements and are accepted by most employers, payroll processors, and financial institutions, we cannot guarantee that any specific third party will accept your voided check. Acceptance is at the sole discretion of the receiving institution.

Intellectual Property Rights

Our Rights

The Service, including all content, features, functionality, software, code, design, graphics, logos, and trademarks, is owned by VoidedCheck.org and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service solely for generating voided checks for your personal use.

Your Rights

You retain all rights to the personal information and banking details you provide. Once you receive your generated voided check, you may use it for any legitimate purpose. However, you may not:

  • Resell or redistribute voided checks generated through our Service
  • Use our Service to provide voided check generation services to others
  • Claim ownership of our Service, software, or proprietary systems

Privacy and Data Security

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Key points regarding your data:

  • Banking information is deleted within 24 hours of generation
  • Generated voided check files are stored for 30 days then automatically deleted
  • All data transmission is encrypted using 256-bit SSL/TLS
  • We never sell or share your personal information with third parties for marketing purposes

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or availability of the Service
  • That the Service will be uninterrupted, secure, or error-free
  • That defects will be corrected
  • That the Service or servers are free of viruses or harmful components

We do not warrant that:

  • The Service will meet your specific requirements
  • Your voided check will be accepted by any third party
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected

You assume all risk associated with your use of the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOIDEDCHECK.ORG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Loss of use or business interruption
  • Cost of substitute services
  • Rejection of your voided check by third parties
  • Errors in banking information entered by you
  • Unauthorized access to your email or voided check files
  • Delays in delivery

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE (I.E., THE COST OF ONE VOIDED CHECK).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless VoidedCheck.org and its officers, directors, employees, agents, affiliates, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Any information or content you provide
  • Your fraudulent or illegal activity
  • Your negligence or willful misconduct

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

Third-Party Services and Links

Our Service may contain links to third-party websites, services, or resources that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.

User-Generated Content and Feedback

If you provide us with any feedback, suggestions, ideas, or other information regarding the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into our Service without compensation or attribution to you.

Dispute Resolution and Arbitration

Informal Resolution

If you have any dispute with us, you agree to first contact us at info@onbiz.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations within 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association (AAA).

The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN YOU AND US INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Exceptions

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights or confidential information.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which our business is registered, without regard to conflict of law principles.

Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in the jurisdiction where our business is registered, and you consent to personal jurisdiction in such courts.

Termination

By You

You may stop using the Service at any time. Due to the immediate nature of our Service, you cannot cancel an order after payment has been processed and your voided check has been generated.

By Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Request by law enforcement or government agencies
  • Unexpected technical issues or security concerns
  • Extended periods of inactivity
  • Non-payment or payment disputes

Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your information in accordance with our Privacy Policy
  • You remain liable for all charges incurred prior to termination
  • Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VoidedCheck.org regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms at any time without notice to you.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

We may provide notices to you via email to the address you provide, by posting on our website, or through the Service itself. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

Electronic Signatures

You agree that your use of the Service and electronic acceptance of these Terms constitutes your electronic signature and your agreement to be bound by these Terms.
